Hi all,

Just a couple of quick questions regarding allowances, I have trawled JSP 752 and my eyes started bleeding after the first page...

I was posted to my present Sqn last August and the plan was for my wife to move into quarters with me, however due to the recession it was nigh on impossible for her to find a new job in her line of work until about a month ago... as a result of this we had to turn down the quarters that we were initially offered and I moved into the Blocks instead (commuting 300 miles every 5 days)... (we could not afford for her to leave her job as we then would not have been able to pay the mortgage on our own flat)...

My wife recently got a new job and we have since moved into quarters, my question is :- Can I claim disturbance allowance for a Mid assignment move on these grounds (Unit admin says no to everything)... Or, if its a grey area, is there anyone I can write to in order to plead my case (I assume that someone must look at these applications on a case to case basis)

Question 2: My/our own flat is now lying empty, it is on the market to be sold, and is also on the market to rent... Are there any allowances that can be claimed in this situation?

Many thanks in advance, I just cannot make sense of JSP's at the best of times...

It's tricky, I did the same and was not allowed to claim disturbance allowance; I was even told I wasn't entitled to removals and storage (overseas). After a well written letter, staffed by J1, I was afforded the removals and storage but not the dist allowance.

The best thing to do is to write a letter, get A1 to staff it through to the JPAC and they will make their decision; the letter needs to be a certain format (in JSP 752).

Not sure about Q2; but I wouldn't bother going to PSF, they're only gona refer you back to JSP 752, it seems to be their default answer these days.
 
Regarding the disturbance allowance, you can claim once for your posting, and once only. The claim should be for the type of property/SLA you intend to occupy for the majority of your tour. There is no time limit for claiming.

Thus, if you did not claim DA for moving into the block, you are entitled to claim for the family move into quarters. Ditto for removals.

If you did claim, as the previous poster stated, you need to staff a request through the Chf Clk to the JPAC for 'extra regulatory treatment'. Part of your case should include your willingness to repay what you have already claimed.

You can claim for visiting a house you own as long as it is not rented out. Not quite up to date on current regs, but I believe it is quite clear cut in the JSP - maybe you just need a closer look at it.
 
My former chf clk remained in his previous MQ for almost a year before moving (and claiming), so as Mightierthan says, its not like it was a few years ago when you had 6 months to make your mind up.

. Mid-assignment Moves. DA is only payable for mid-assignment moves where the move of accommodation is for Service, compassionate, welfare or medical reasons. Where the Service person’s accommodation entitlement changes due to promotion or a change in the size of the immediate family (other than as a result of first setting up of home) the Service person will normally be entitled to a mid-assignment move and therefore the associated level of DA. The Service person must have an expectation of occupying the new property for at least 6 months. Mid-assignment moves for other personal reasons, including on estrangement, and for operational deployments do not give an entitlement to DA.

 
oh and although not relevant in this case, the time limit is normally 6 years....but can differ for each allowance. Also if the rules and regs on a particular allowance have changed in the meantime a case must be submitted.

Another one sorry from the JSP (available in the public domain):

Service personnel who opt to move accommodation mid-assignment for personal reasons, including first setting up of home, are not entitled to a mid-assignment move of PE at public expense.....authority for mid-assignment moves at public expense on compassionate, welfare or medical grounds may be requested through the SPVA PACC.
 
However, if the OP has not claimed DA or removals, then it is not a mid-assignment move; it is his family move, on posting, which he has delayed, and which he is quite entitled to delay, as long as he will occupy a MQ for the majority of his tour.

The only sticking point will be if he already has claimed - well, have you...?

I seem to remember the time limit used to be 6 months but changed recently.

If you move into temporary single accom you now only have 3 months to make the perm move into accompanied (either MQ of Private) accom.

Might be worth having a chat with the chief clk, he may be inclined to help you if one of his staff gave you duff gen that has cost you money:PDT_Xtremez_15:
