I am posted after 1st April, i have 2 e-mails both contradicting each other. Please can anyone clarify this.

Do i lose all my carried over leave on posting after the 1st April? ie, my balance will be reduced to 38 days?




I have been told on one hand this is the case and on another it is not just any leave you have got signed by blood of any leave above the 15.



If it is true, they will not be seeing me in March.

I would like this clarifying as well as I have been told both versions myself.
 
I'm not a scribbly but I think its next year that leave cant be carried over. Its a 3 year cycle, so Apr 2011, Apr 2014 etc.

Unless it has changed since they introduced the 38 day leave year.
 
Have a look at Brize's SRO's (might have to look at the archived list) dated 04/02/10, there is something in there that might help.

I believe the idea is that all leave over the 38 ALA is taken prior to posting out - not an issue for those posted in the latter half of the year, more of a concern for those moving in early April/May.

The JSP 760 hasn't been updated for a while, the most relevant part that refers is:

"After 3 years or at the end of a tour, whichever is sooner, personnel are to take all (carried forward) untaken leave. The leave is to be taken whilst on the strength of the losing unit."

so that the "pain" is felt by the losing unit.

This is just my interpretation of the regs, you may find that different units take it different ways.
 
Your balance will be reduced to 38 days on your posting date. If, for example, your posting date is 19 Apr, then you could take your 15 carry forward days from 1-18 Apr, and your relocation 19-24 Apr.

Unfortunately, those posted on 1 Apr have the biggest problem, but if you have only just found out, ask for your 90 days notice.
 
Has the RAF given any justification for the individual airman to take the hit on this instead of the management? If you cannot be released from your duty to take leave before you are posted, and I think that's happened to all of us at some time, why should we be the ones that suffer?
 
You can always apply to the new unit to carry over your, already carried forward, leave. Personally I think the new system sucks and is not very well thought out but I do understand the principle behind it.

How long before someone mentions getting paid for untaken leave?
 
I go OOA next week and am posted upon return. I have 10 days or so carrying over after 31 Mar.

Can anyone tell me if this will be allowed to carry over to my new Unit?
 
I would suspect this is another little nugget the lawyers would have a field day with should people lose leave. Is there no such things as grandfather rights? The Military big boys seem to be moving the goal posts everywhere you look. What other organisation would get away with this?

You can apply to the new station to carry forward your leave which, in this situation, is quite justifiable.

I don't agree with the way in which this has been brought in and whilst it won't effect me, no more postings, the carrying forward of annual leave has become a norm for most people and it now seems to adversley effect some individuals, those posted early in the leave year, rather than those posted after the summer hols.

Just another minor chip off the old welfare block.

IIRC the Armed Forces have stated that, unless conducting operations or in direct suppot of operations, then they will follow the requirements of the UK's Working Time Regulations (WTR).

These give 'employees' a minimum entitlement to paid holidays of 5.6 working weeks (this includes bank holidays). IIRC the Armed Forces' Individual Leave Allowance exceeds this 38 days given against an entitlement of 28 days.

So the carrying forward of leave, or not, is not an issue that can be challenged through civil means. However, the chain of command should (allowing for the ops and direct sp to ops exemptions to the WTR) permit their personnel to have 28 days paid leave a year.

A couple of notes:

Standown days such as post AOCs etc count towards these 28 days.

There is nothing to say that either the WTR's paid holiday or the Armed Forces Individual Leave Allowance have to be given when the individual wants to take the leave. Therefore, just like many civilian companies, the chain of command can tell people when to take leave (whether that be as block leave or on an individual basis as part of a controlled programme of absences that enables the unit to achieve its outputs) not always accede to the individuals requests.
