So star Castleford RL wing Denny Solomona has moved to Sale Sharks RU opening up a proper tin of worms. (The links a bit of a long read)

http://www.bbc.co.uk/sport/rugby-league/38341209

Seems he simply stated he had "retired" from RL and much to Castleford's displeasure, walked away from the remaining 2 years of his contract. He then declared he was going to play RU for Sale. So Sale get a player without paying a transfer fee and Castleford lose a player with no sell on money. Are they still two sports that far apart? It's not like he retired from table tennis and then decided to play Football. Hypothetically what if Courtney Laws suddenly retired from club and international RL then popped up a week later as a loose forward at Huddersfield Giants. Does Bosman now come to rugby?

At the end of the day, the RFU and Sale are using this as a test case. They can afford the transfer fee, they are seeing how far they can push it and if it looks like they wont get away with it, they will end up paying in the end with an undisclosed out of court settlement. The net result is they will have their player, sooner than they expected, for the amount of money they put to one side anyway.

The guy has shafted RL and Cas, he needs to reap what he sows and have nowhere to return (including NRL clubs) when his RU career fails. As for Andy Clarke, he should have his registration with the RFL terminated. His brother is bound to be defending him on the opening night of the 2017 season, maybe Phil should do one too just for good measure.

There is a serious lack of integrity from multiple parties going on here :

Solomona for walking out on a contract he had two years remaining on – he could have signed a 1 year contract but wanted a 3, which has 2 years left on it. (Good luck getting a team back in RL if the RU move doesn’t work out!)

His agent, for encouraging him to walk out on a contract, rather than pushing him to honour the contract he signed. The guy should lose his accreditation for this.

Lastly Sale RU. Their other signing, Charnley, they waited until his contract ended at Wigan before he started with them (and frankly Sale got a better player than Solomona into the bargain ). Sale did approach Cas with an offer 3 times (with in the range £100K to 150K transfer fee)

However, Cas turned down the offer 3 times, and state dteh player was not for sale. Shortly after which he ‘retired’ and then signed for a RU club.

Sale still say they want to settle out of court, and pay the fee they had already offered. However, what it boils down to is should a professional sportsman be able to walk out on a contract at a club to take up an offer at a club in a ‘similar’ sport.

Personally I think it should have come to the sports arbitration service (CAS) – but am interested in the ruling on this , it boils down to are contracts worth the paper they are written on or not?

If he was moving from one RL club to another then his contract obligations would perhaps carry more weight but as he's moving to a different sport (how different is debatable) the obligations seem to have been ditched. If George Ford moves to Sale from Bath no one will care if all the correct fees are paid but if he said to Bath I'm retiring from RU bye now and ended up in RL then ...........

And he's also said he's made attempts to settle out of court too. That indicates Sale know they are on dodgy ground.

No doubt it will be settled out of court, but I admire the stance Cas are taking here. The player, his agent and Sale have tried screwing them over and it would be just and fitting if they were forced to pay his contract (plus any potential bonuses) up in full, plus legal costs.
