Does anyone know the actual ruling on how long Formal Warnings are live for ? I was given one 2 and half years ago and was at the time informed that it would only be active for 3 months (which used to be 6 months). The implications for those 3 months was that I could not get promoted and could not sign on, I have now found out that I was sold a duff one. This long down the line and have just found that my High Rec for that year still scores an amazing 2 points out of 18.

Just wondering if I will have to wait until this drops off the end of my assessment requirements which will be 5 years as a SNCO, and if this is the case I may have to book another exped....

Would be interested if anyone has views and any info that is documented.

My P1 knowledge is extremely rusty, but a Formal Warning is only "live" for 3 months, ie pull your socks up over the next 3 months or else we'll take further admin/disciplinary action. extend the FW. However, a Formal Warning is mentioned on that years assessment therefore, probably always taken into account on a promotion board. It's also recorded on your F445B and I believe subject to the rehabilitation of offenders act so remains on there for I think 5 years.

One the the manning guys may want to jump in with a comment on how they do the scores on the doors for somebody with discip on an assessment as I really can't comment on that area.

Whilst it may now be spent, it will still be on your F6000's that are presented to a Prom Board and will effect your chances of Promotion. Lets face it, if you have 2 guys that are equal in most respects and one has a FW on record, albeit 3-4 years ago, and the other doesn't who are you going to select?

Not always the case and a lot of variables but I suspect that you may have to wait until the F6000 with the FW has dropped off your scores to have a decent shout at promotion.

SJAR rolled out Nov 07 so 2009 is his 2nd SJAR, not having all the facts I took the assumption that this was something that happened a few years ago. Yeah, Yeah I know all about assumption.:PDT_Xtremez_14:

I have had two formal warnings both were issued over 6mths not 3. And best bet is wait until they no longer show up on the board and you will be happy. Usually 3-4yrs after the last report it is mentioned on. Since I am getting picked up this year that would be about right.
 
Formal Warnings come under the 'governership' of QR1027. They last for 3 months (a change that occured a few years back), where there is a review each month. Every Formal Warning should be rehabilitative with a measure on how an individual needs to inprove. Failure to do so will lead to an escalation in severity (extend FW for 3 months, posting, discharge etc).

They are not subject to the Rehabilitation of Offenders Act, so hence have no formal expiry. However, the rule of Natural Justice applies and it is common practice for them to be removed from the day-to-day ACOS Manning dossier after 5 years (however, they are still a permanent record). Ordinarily a FW will set you back 4-5 years in your career (dependant upon the offence that attracted the FW), as they are reflected in your ACR so the prom brd will see that you have a FW for the amount of years they look back.

Goat Blower to answer your Q - A FW will set you back for as long as the Prom Brd review your previous profile. To get a High Rec while also having a FW (noting that I am not aware of circumstances) was a daft thing for your ROs to do - ie the High Rec looses instant credibility - you would have been better off getting a yes for promotion but with a strong evidence based narrative. Yes you will probably have to wait until it drops off after 5 years. Oh and you haven't been sold a 'duff one' either.
 
Might put a spanner in the works for getting your LSGM too. Not sure though.

Cheers all for replies, I agree with hindsight regarding the High Rec but you certainly don't argue when offered. The FW was for conduct unbecoming for a SNCO so will have to wait 5 years for it to be dropped off, it was in 06/07 report so will just have to wait and see. Would have certainly have dealt with it differently if had known this at the time.

Again thanks, not sure what route to take now, done 20 years and have 10 left, wait and see if the crown comes after has dropped off, take a commission or just come out and total change of career....
