Help with GYH.

Does anyone know if the RN come under the same regulations as us with regards to GYH mileage?

My fella has been living with me since May (he is in the Navy based at RNAS Yeovilton approx 260 miles from where we live). He has been claiming GYH mileage but now his PSF equivalent are saying they are going to stop it.

We have the council tax/electricity/gas/water all in joint names and his bank address is here as is his motorbike insurance/car insurance but they are saying as the house isn't in his name he cant claim. Now he pays half of all the bills/mortgage etc to me and we do currently have this house on the market as we are buying a bigger one and that one will be in both of our names. Are they right that they can just stop his money???? They said they want to see the deeds for the house or a rent book to show that he is on the lease for here but I already had the house before we even got together. Seems like he is being penalised for me already being a home owner?

I'm sure its all written down in the TRI service JSP as to what is and isn't allowed.
I'm sure the HR experts will back me up on this, if he falls into the criteria whichever service he's in he's entitled.

Edit,

Rent books are obtainable from good stationers, you could get one and back date it with all the money he's paid in bills as rent as your his Landlady.

Yeah that's what I said I'd do write him out a rent book. All seems a bit ridiculous to me. FFS hes given them the council tax, his bank statements, car/bike insurance and shown them on his bank statements where he pays me direct debit every month the rent!! I think they actually want blood!
 
Reading JSP 752, Chapter 5 Section 2, I can't see any reason why he shouldn't be able to claim GYH for maintaining a private property (PMP) if he can produce the documents below. Regulations state:

However, if the house is in your name and you are not married, then current regulations do not allow him to claim as he does not have a financial responsibility for the house; he could walk away tomorrow and not be responsible (he could even stay, and not be responsible for any payments).
It's harsh, but if it were allowed for co-habitees then there would be very little in place to stop people submitting fraudulent claims, or claiming for different parters every week, depending on who was in favour.
He could try submitting a case to the JPAC, but I wouldn't get your hopes up too high.

The rules for claiming GYH have been tightened over the last year. Having read what the OP wrote, I would also turn his application down. He would have to provide one document from each of the following categories, plus an additional one....

Removed extract from service document - Mono

Whilst your boyfriend may be able to provide all five from Group 2, I suspect he will have problems providing anything from Group 1 or 3.

My advice is to get him to let it drop, and then once you have purchased a property together, re-claim it as he will have no problem providing anything from that list.

I think as he has chosen to live there he doesn't really have a claim?

It may have changed, they seem to change all the time. But if he is then posted somewhere else and you are in an official partnership it may be different?

Maybe if you were in a same sex relationship it would be different?

I would keep quiet and just be happy with what he already has claimed.

You're a bit behind the times mate. People who live in single accom, whether married or single, can claim HTD to travel home at weekends to either see their family or maintain their private home.
A bit confusing because everything comes under the umbrella of HTD now, whether it's travel at weekends only or travel from MQs/private daily.
 
The rules changed on 01 Apr 09. If he was already in receipt of GYH(T) and it was duly authorised with a copy of a council tax bill then I would be asking the question of his UPO why does he have to provide the extra evidence now.

The regulations are quite clear that:

"The documents are to be provided on initial claim and where there is a change in personal circumstances which may affect entitlement."
