I have recently found out that if you are a serving member of the MOD and you live away from your family home during the week or shift time etc, and as a result you have to have a block room or married quarter then you must only pay 50% council tax. THIS IS THE LAW.

The actual LAW is " The Local Government Act 2003". This act was brought into force to allow the councils to increase council tax on second homes to 90%. As a protection to ourselves they placed a clause stating the 50% rule, this also applies to workers of the Ministry of Religion ( vicars etc).
The rule came into force in 2004 so if anyone has been paying full council tax you are due a huge rebate. I myself have had this argument with my Local council and I have just received a letter stating that it is true and they apologize.
The way it works is that we pay CILOCT out of our wages, this is "Contributions in Lieu Of Council Tax" and this donation is agreed by the government , The rule applies EVEN IF THE SPOUSE LIVES THERE!! and IT IS FURNISHED!! BUT YOU MUST BE IN A BLOCK OR QUARTER.
This is the link you should show your council and then go on line and type in :PDT_Xtremez_30: MOD second home council tax, and you will see many councils all offering this 50 %.
Please all contact your councils if you did not know and question this with them, good luck.

HR have nothing to do with your council tax. They take your CILOCT off you and then the MOD will pay local authorities. No direct link to Council Tax.

The rubbish bit is because there was a big fuss aboout it and i looked at it when the op allowance was bought in.
The other house is your Home, where you keep most of your stuff and hence you cannot get the 50% second home rate, or the single person rat/ allowance for the wife before you ask.

I've just checked this with my brother in law, who runs the council tax for my local council. Its on a case by case basis and at the discretion of your council - its not carte blanche. They are wise to it, so don't hold your breath!

I'm unsure about this,

I own a property in Stoke on Trent where my wife and children reside . Between Dec 2007 and Jan 2009 I lived in the block 130 miles away Mon to Fri. However, as "married unaccompanied" I did't pay any accom charges or CILOCT so should I approach my council regards a possible rebate?

this might make it a bit clearer as far as what I think the OP was on about.

If you HAVE to have another home provided by the MOD and you pay COUNCIL TAX or are overseas than you may be able to claim the discount (the act protected our 50% discount rather than being reduced to 10%)

If you have an empty house and are not renting it out or storing any furniture there then apply.

There are other rules aout students not having to pay and such things.
