After some advice please.

If I have a civil court summons on my jpa file from 2007 which resulted in a fine, can this stop me being promoted. No service action was brought against me(formal/informal warnings).

I have recently been informed I have been promoted to Cpl, but when my drafter was about to release me, this was flagged up on my Jpa file. Which has resulted in him having to push it back up his chain of command for permission to release me.

On my SJAR for that year there is no mention of the said summons, or any disciplinary action against me.

Also if they were to look at it as a formal/informal warning how long can these hold you up for in promotion.

I don't know whether it can hold you up or not but if it can, when it comes to Promotion, the Board will read your last 3 assessments.

Saying that though, if there has been no warning issued, the punishment has been spent and it hasn't been mentioned in that particular years SJAR I can't see how it would trip you up.
 
I think things like that are supposed to be mentioned in the SJAR, even if just as a single line in an otherwise shining example and the assessment clerk at the time should have spotted it. I could be making it up from half understood half heard conversations around various places I've worked though.

Surely the Service Test should be applied?

If it does not affect any aspect of the Service or it's operational output then it does not require a mention.

The assessment clerk dosen't check for that. If there has been no P1 action against a person, why would the assessment clerk check or even know about it?

Was P1 informed at the time that you had been summoned to a civil court, and if so what did they say?
 
I am shocked that no action was taken against you. Even when you are offered promotion, your offer must go through P1 and they will pick it up and not reccomend the promotion.

What should have happened

If you informed P1 that you had received a fine, not a fixed penality or similar, then P1 would have taken action that was appropriate to the situation at the time. I'm assuming you did as it is on your record.

If any disciplinary action or administrative action took place then this should have been mentioned on your SJAR/6000, in the year of conviction, this could be mentioned in either a positive manner or a negative manner depending on the circumstances, your attitude, out of character, etc, etc.

If no administrative action nor disciplinary action was taken then there might have been no need for a mention in your SJAR.

A fine is normally valid for 5 years so if you had the summons in 2007 and went to court and were convicted in 2007 the punishment is still notifiable until 2012, check with Citizens Advice for special cases based on individual circumstances.

If it was mentioned in your SJAR then it should have been picked up by the reading cell and appropriate action taken. If it was left off your SJAR by mistake you should be placed in the position you would have been if it had been mentioned, this does not necessarily mean that you won't be promoted but it may effect your place on the list.
