One bit of info, in case anyone ever ends up in a similar situation.

I couldn't find any solicitors who had ever dealt with a case like this, that meant my costs went up because part of his fee was for the time taken having to actually research H&S law itself. We're keeping costs as low as possible by having main contact via email, but it's still mounting up and it's gonna be a BIG chunk of my ops allowance from my OOA just to have legal representation so I don't get shafted.

I think you'll find that it is not your email account but an account the RAF has given you for official business and therefore is able to look at it to it's hearts content.

My wife was surprised the other day when her boss commented on her english in one of her emails that didn't go to him, ie he picked it off the server.

Now bu99er of this is V2 thread and I'm waiting for the next installment.
 
Final one from me on this topic.

Went to court this morning. Due to a monumental cock-up between the MOD Police and the CPS, there was no prosecutor there to prosecute me. We were very close to having the case thrown out there and then, but the magistrates told us to come back at 2pm.

Had a nice pub lunch and went back, was in by 2:10 because a prosecutor actually turned up. Then it took 20 minutes for them to work out the maximum penalty they're allowed to give for this offence, which was quite embarrassing for them, especially when they were checking (I kid you not) Wikipedia for the info.

When it all started, the prosecutor did his bit, then my brief did his bit (he did a cracking job). When all was said and done, they gave me a £35 fine and no court costs because they'd messed up in the morning. I do have other costs such as solicitors fees and I also have to pay some compensation to the MOD (which I'd already agreed to pay).

So yeah, my record will say a £35 quid fine in magistrates court.

I surprised they let them get away with using Wikipedia as a legal reference tool, since it can edited by the general public, and not part of the HSE for which they are trying to prosecute.

Congratulations on getting a good-ish result, shame it had to go that far when a royal bo**ocking would have done.
But I would expect your legal bill to be around £1500
 
Having just read the whole thread, I'm glad you only got a token punishment. This should have been a bo!!ocking at the most.

What amazes me is the amount of public money wasted on pursuing the case. Your £35 fine must surely be a pittance against the costs of getting you to court.

Congrats on your case mate. Abit daft to fine you £35 for putting a sock on your smoke detector. I know you said you covered it up but to my understanding a sock is made of cloth so is breathable and would detect smoke any way just not the crappy candle smoke for a while.
If it was a plastic bag or a plastic pot I would think abit differently.

If other people are in bother with a H&S prob you can always look in the JSP 375 (MOD Health and Safety publication) or the HSE website with all the gen. If it says MANDATORY its law but if it dosen't say that it's more of a guide on a certain subject.
(Done Cpl Further Training in Aug and alot of it is on H&S).

Don't forget to take all details to your friendly P1 soon as - you don't want to get done for contravening SROs/SSOs when they get details of your case forwarded from the crime database!
 
This is unbelievable. I'm ex RAFP and must say that in my time this would have resulted in a report to your OC. Choice was always to charge or report. Then you would have had your bollocking and perhaps been volunteered for some extra duties.

What you did was a bit stupid. But you are not alone here. I just didn't get caught....
