I thought this thread would be full of people like me that have had letters advising the details of the recovery action being taken against them. I received my letter today I am to pay 4 days gross till the monies are recovered, starting April 30th pay.
 
This is a massive balls up. Having read this thread from start to finish I really can't begin to comprehend what you guys affected by this must be going through - to me it smacks of duplicity from higher up.

Surely there is some legal way to challenge this? Or failing that, a campaign to highlight the issue to the public and the Press? As one poster put it, a lot of people will have made financial commitments and this repayment is grossly unfair regardless of whether it was actioned "in good faith"...
 
Hmmm, I put an AIP in as soon as they were allowed (2001-2?) using my Appo BTEC qual.

No letter yet and I hope never to receive one neither!

Think that's too far back Mike.

Been following this since it started, utterly appalling situation people have found themselves in through no fault of their own. Losing £300 odd from your pay is a massive hit for lads and lasses with mortgages and families. Hope it can be worked our for you all.
 
Wait til you get out and the HMRC start having a pop.

If you are leaving and you end up on the higher tax rate - make sure you let your pension people and the HMRC know. Word to the wise.
 
What about the people who are out now who were audited in 2012?
 
Briefing we got was that if you have left then you will be contacted by DBS/HRMS/SPVA to arrange re-payment.

Thinking aloud here, is there anyone likely to be in a position whereby the money cannot be directly grabbed from either their pay or pension, i.e. who the treasury would have to take to court to try to retrieve the 'overpayments' from?

Well I haven't heard anything since I left and it all kicked off, no letters no calls, nothing.....If I hadn't had access to the goat I would be in for a big surprise if a letter after all this time drops on to the mat.
Here's hoping I don't.

They can pursue all they like, you be a fool to respond with anything other than soundly worded a rebuttal. IIRC it's pretty nearly illegal to touch your pension, any misleading or threatening letters would be seen in a bad light by any court.

How would the "statute barred" rule affect any proposed collections?

Would it apply to this scenario in any cases?

only submitted one AIP as a CPL in 2004(fitters course BTEC) and not been touched. I feel your pain guys and gals, good luck with the fight and i hope u all win
