The basic answer is it's your problem to claw back any tax or NI and you'll get sod all help from HR.
Been there, seen it, failed to do it

I'm pretty sure that a tax and NI rebate was actioned on the debts approximately Mar 13. This reduced the debt in my case from about 2.2k to 1.6k.
 
If they did it right the recovery of the AIP will come out of your pre tax salary and reduce your liability this year so for some this won't be that much of an issue.

If either the overpayment pushed you into the high tax band from the low or the recovery drops you into the low band from the high, then you'll need to talk to the tax man, however, it might be worth your while keeping quiet for the latter.
 
The tax repayment back in Mar 13 is what screwed me over, and when I chased it with the tax man they just slapped another £120 tax bill on my next pay! keep quiet and take it on the chin.
 
If you were expecting debt money not to be taken this month, from your pay, for whatever reason ... you might want to check JPA today. Payslips are on and it looks like money is being taken regardless.

Would be good to hear if people have had the debt frozen and how.

Same has happened to me and others. Apparently there has been delays processing objections and with the pay run being brought forward it has meant even if you submitted an objection in plenty of time you most likely will still have a full 4 day deduction coming out.

Have been informed I "should" get a direct payment to my account for the amount I'm standing to lose out on.

Unacceptable in my opinion.
 
This whole debacle continues to be the gift that keeps giving! Just when you thought it couldn't be mishandled any worse it is. Good luck to all those who have lodged objections, stick it to the man!
 
Been rejected and the money is coming out this month!! From what I have heard not one appeal that been accepted. They have only let us appeal to make us think that we may have a glimmer of hope not being absolutely ****ed over

A couple of people earlier on in this thread said their's had been wiped. Would like to know how if they're turning down most appeals.
 
What frustrates me is over the last three years the amount showing has changed 3 times with no explanation
 
Has anyone wedged a defence using the principle of estoppel?

It's been talked about previously. Apparently it doesnt work with the government.


First Appeal rejected on the basis of treasury guidelines - "When an overpayment is discovered payment Will be pursued irrespective of the circumstances in which it arose."

However it does say on the next paragraph that " All the evidence provided has been carefully reviewed against these guidelines. As good faith alone is no longer sufficient to justify an overpayment of pay or allowances being written off against the public purse the basis of your objection rests with the defence of Estoppel. When the lack of knowledge is combined with the fact that the enrichment is contrary to the rules and is funded out of public monies the evidence provided in your submission does not constitute a defence for write off."

Debt not waived. Endex.

Second appeal going to paper as we speak in accordance with advice from Wilkin Chapman LLP.

  1. Told that not allowed to put in Service complaint until after all appeals have been completed. Clarification sought.
  2. Told that if dont accept the first appeal failure and go for a second appeal i then lose my right to financial hardship claim!!! Clarification sought.

And probably most importantly - There are plenty on here with the problem Lets get together somehow and put a proper case forward using Wilkin Chapmans as the vent point. Maybe we can then get something concrete done about it. The system is at fault. FULLSTOP. Constructive replies welcome ! :)

I've emailed them twice asking for clarification of the amount owed and a breakdown of how the amount was calculated. So far I've heard nothing.

Until I get a clarification as far as I'm concerned the letter is just an attempt to defraud me and make me hand over my money illegally. (I told them this too)

A colleague in a similar situation appealed the amount through the DBS first objection route. Was informed that any dispute about the amount should be raised with local admin who will go via the focal point and double check/correct the debt. Any questions about how the amount was formulated doesn't appear to be of any concern to DBS as the recovering organisation and clarification can/should be sought from local admin.

if you haven't appealed then it'll just be coming out at the standard draw rate of 4 days pay.
 
It's sounds like they are just cracking on with collecting the sums and depending upon a lack of cohesion between any objectors to get away with it...they have a legal service to draw upon and they will be assuming that no one has the appetite or financial means to fund a protracted legal bun fight...then they will be hoping that as servicemen you'll do what you do all the time which is to suck it up and crack on. In other words unless you go for a group action or one of you has bounteous private funds they will win and you will have to make yourself a mug of man-up...
 
As I'm no longer serving they can stuff it up their arse unless they respond to me. Without proof of wrongdoing i wont be handing any cash over, it was so long ago I cant remember what I even submitted for AIP. If they respond to my requests for info I will happily pay...

Any good Gen on how the service complaint will look for this? Admin Office here not interested in helping...

Ref the financial hardship - You CAN put in a second appeal and then put in for finacial hardship if its rejected.
